These Terms of Use govern the use of the mail-order service (hereinafter referred to as "the Service") for products (hereinafter referred to as "the Products") listed in various product catalogs issued by Bamboo Hornet LLC (hereinafter referred to as "the Company") and on the Company's website (hereinafter referred to as "this Site") (hereinafter referred to as "the Company's Catalogs") and sold in Japan.

Article 1 (Application of these Terms of Use)

Except for those provisions that are naturally not applicable due to the nature of the Products, these Terms of Use shall apply equally to all customers who have completed the Company's purchase procedure. Customers shall use the Service only after fully understanding the contents of the Company's Catalogs and these Terms of Use.

If the Company establishes separate terms and conditions regarding the Products or the Service, those terms and conditions shall take precedence.

In the event of any conflict between the provisions of these Terms of Use and any other agreements between the customer and the Company (including cases where contract terms are stated in the customer's order, etc.), these Terms of Use shall take precedence.

Article 2 (Contents of the Service)

Customers may purchase the products through this service in accordance with the terms and conditions described in our catalog (specifications, price, delivery method, usage precautions, etc., but not limited to these). However, due to the nature of the products, we may exclude some products from this service without prior notice or warning, based on our established criteria or at the discretion of the manufacturer or our company.

Customers may use the various services provided on this site in accordance with these terms and conditions and the usage precautions posted on this site.

The service area for this service is within Japan. However, this excludes areas where delivery is not possible, as indicated in our catalog. For countries other than Japan, we will provide services to deliverable locations after separate discussion of the terms and conditions.

For orders requiring a quote at the price listed in our catalog (hereinafter referred to as "orders"), and for other orders requiring a quote at our discretion, the price and shipping of the products will be determined by the quote.

Article 3 (How to Order Products)

Customers can place orders using the methods specified in the following items. However, depending on the type and quantity of the product, including custom-made items, we may limit the ordering method.

An order from a customer will be deemed valid when we receive the order in accordance with this clause. If we are unable to receive the order data from the customer due to communication problems, etc., or if there are deficiencies in the required information to be included in the order, the order will be deemed invalid. In this case, we will not be liable for the customer's inability to purchase the product or for any damages arising therefrom.

The sales contract for the product ordered by the customer will be concluded when we receive the order in accordance with this clause. However, this does not apply if we promptly refuse the order after receiving it. In this case, we will not be liable for the customer's reliance on the conclusion of the sales contract or for any damages arising therefrom. Furthermore, if we deem it particularly necessary, we will conclude a separate sales contract or change the sales conditions.

If any costs are incurred in relation to customer requests concerning an order, we reserve the right to require the customer to bear such costs.

Article 4 (Order Changes and Cancellations)

Changes to or cancellations of an order (hereinafter referred to as "cancellations, etc.") are permitted only if the order is placed, within 3 days of receiving the product, and only if the product is unused and has not been modified or deformed by the customer.

Cancellations are possible after the order has been placed, the product has been delivered, and the customer has received the product.

Since the delivery company places the order and begins delivery after the order is placed, cancellations are not possible until the product arrives at the customer's address, according to the contract.

After receiving the product, the customer must promptly return the product to the address provided by our customer service center. In this case, the customer will be responsible for shipping and other expenses.

Refunds will be made within 5 business days after the product arrives at our company and its condition is checked, minus the shipping costs incurred.

Handling of Initial Defects: We will handle any deformations that affect driving performance within 3 days of product arrival and opening the product.

After installation on a vehicle, any repairs will be subject to a fee, regardless of the reason.

Article 5 (Shipping of Products)

We will ship the products to you based on your order. However, we reserve the right to determine the shipping date on a case-by-case basis depending on the type and quantity of products ordered, the order date and time, etc.

Shipping begins immediately upon receipt of your order. Cancellations are only possible after delivery to the customer. We cannot process cancellations after delivery.

The shipping date and the delivery date to the customer are different. When ordering products, please refer to the estimated delivery time listed on our website. Please note that delivery may not be possible within the estimated delivery time for your region due to transportation environment reasons such as weather, traffic congestion, road construction, etc., shipping times (year-end and New Year holidays, summer holidays, mid-year and year-end gift seasons, etc.), and other reasons (delivery company strikes, customs changes, wars and conflicts, earthquakes, tsunamis, etc.). In such cases, we shall not be liable to the customer in any way.

If the customer refuses to accept delivery or the product is returned for reasons attributable to the customer, the customer will be responsible for all necessary costs, including shipping and taxes.


◎Handling of Lost or Damaged Items During Delivery
If damage occurs during delivery, please apply for EMS insurance after receiving the item.
EMS insurance is a guarantee provided by the post office for problems during delivery.
The insurance application must be made by the recipient.
We consider the application for EMS insurance in case of damage as part of the transaction agreement.
If the EMS insurance result is insufficient, we will consider providing further compensation and will endeavor to satisfy the customer as much as possible.
If the customer does not apply for EMS insurance, we will understand that they are not seeking compensation, and we will consider the item ineligible for insurance.

Article 6 (Delivery of the Product)

Delivery of the product will be considered complete when the product is delivered to the delivery address registered by the customer or the delivery address specified at the time of order (however, we may limit the delivery addresses that can be specified). For heavy or large items, a separate delivery method designated by us (such as curbside delivery) may be used. The customer will be required to affix their receipt stamp to the delivery slip upon receipt of the product.

If we are unable to verify your nameplate or other identification, we may be unable to deliver the product.

If we deliver the product to a location other than the one you registered or designated, we may require you to present identification such as a driver's license, health insurance card, or passport to verify your identity. (In this case, we will record the address, name, registration number, etc., as stated on the driver's license, health insurance card, passport, etc.)

Article 7 (Refusal of Acceptance, etc.)

If you refuse to accept the product, or if delivery to the delivery address is impossible due to circumstances on your end (including absence), we will consider the sales contract for the product to be automatically terminated. In such cases, you will be required to pay the equivalent value of the product and any other damages incurred by us. However, this shall not apply if we have authorized different handling in light of the nature, type, quantity, and delivery system of the product.

Article 8 (Inspection of the Product)

The customer must inspect the product within 3 days of receiving it and before installation to confirm its name, model, quantity, and check for damage, deformation, defects, or non-conformity. If any defective products are found, the customer must notify us within the specified period using the contact information provided on our website.

If we do not receive notification within the specified period, we may deem the product to have passed the customer's inspection.

Even within 3 days, if the product is installed on a vehicle, it will be deemed to have passed the inspection.

Article 9 (Measures in Case of Failure)

If all or part of the product fails the inspection as described in the preceding article, and we confirm the product and determine that the defect is clearly attributable solely to our fault, we will promptly provide a replacement (or re-provide the service in the case of a service) or, based on the customer's instructions, refund the price of the defective portion of the product. The customer will be responsible for creating shipping labels and other documents related to the return.


Article 10 (Exemption from Liability for Force Majeure)

In the event of delays or inability to deliver goods due to natural disasters (including, but not limited to, earthquakes, floods, and fires), changes or repeal of laws and regulations, actions based on the exercise of public authority, transportation problems, labor disputes, or other unavoidable circumstances, we will notify the customer within a reasonable period appropriate to the circumstances. However, we shall not be liable for any damages or expenses incurred by the customer as a result.

Article 11 (Over-delivery)

If we deliver more goods than ordered due to reasons attributable to us, please contact our inquiry desk and promptly return the goods to the address provided by the inquiry desk. In this case, we will bear the shipping costs.

Article 12 (Handling of Returns and Exchanges)

Returns and exchanges (hereinafter referred to as "returns, etc.") will not be accepted for any reason after the inspection period specified in Article 8 has elapsed.

Article 13 (Obligations Regarding the Use of This Product)

Customers place orders for this product based on the following conditions regarding its use. We will not be liable for any damages incurred by the customer or a third party as a result of using this product if the customer or a third party uses it in violation of the following conditions.

(1) Regarding Custom Bikes

Custom bikes may not be covered by the manufacturer's warranty.
We do not guarantee all safety standards, legal regulations, and safety in all countries worldwide.
They are art pieces (for appreciation) intended to be enjoyed for their design.
We do not guarantee compliance with all legal regulations in all countries for use on public roads. This is not covered by the warranty.
Use on public roads is the purchaser's own responsibility.

K-SPEED cannot make strict specification changes to comply with the legal regulations of each country, so purchasers may need to make changes after purchase to comply with the regulations of each country.Please understand this before purchasing.

(2) Regarding the Use of Custom Bikes and Custom Parts

Custom bikes are for enjoying the design.

Because we disassemble standard vehicles and add different parts, we modify them by grinding, drilling, and welding to fit the standard vehicle. Minor scratches and abrasions may occur during this modification process.

Custom Parts
Custom parts are not genuine parts. There may be slight distortions, color differences, or gaps in the joints.

All K-SPEED products are for custom vehicles or custom parts, and differ from mass-produced products from aftermarket manufacturers. Modification may be required for installation.

Parts may need to be ground, added, or the angle of brackets adjusted to fit the vehicle. By purchasing, you acknowledge that you understand the characteristics of custom parts, which may not be a simple bolt-on installation.

Furthermore, we do not have the same maintenance or after-sales service system as aftermarket manufacturers. Please understand that we cannot provide the same level of service as aftermarket manufacturers (e.g., replacement vehicle provision, obtaining a 125cc motorcycle license plate).

These are not mass-produced products.

Because this product incorporates commercially available parts, specifications for some parts may be changed without notice.

Some parts have been modified from those shown in catalogs or photos to comply with Japanese safety standards.

Installation and use of custom parts are the buyer's responsibility. Any scratches or damage that occur during installation or use are not covered under warranty.

Adding custom parts may void the motorcycle manufacturer's warranty.

Adding custom parts may alter the balance and air resistance, potentially affecting riding performance; however, any such effects are not covered under warranty.

Adding larger tires will also affect fuel efficiency and acceleration.

If you require the same performance, paint finish, and balance as a commercially available motorcycle, a custom motorcycle is not recommended. Please choose a standard motorcycle.

Article 14 (Product Warranty)

If, within 3 days of receiving the product, an initial defect (hereinafter referred to as "initial defect") such as the engine failing to start or electrical system problems (e.g., turn signals not flashing, horn not working) is found due to reasons attributable to our company, we will repair or replace the product (hereinafter referred to as "this warranty"), provided that you provide us with written notification detailing the defect to our satisfaction. In this case, we may request the manufacturer of the product to perform the repair. Please note that custom-made products are not covered by this warranty.

If the product is covered by a manufacturer's warranty, we may apply the manufacturer's warranty.

The following cases are excluded from this warranty, even within the warranty period:

(1) Malfunctions resulting from use for purposes other than those specified.
(2) Malfunctions resulting from the use of this product in aerospace equipment, nuclear equipment, weapons, or other military applications.
(3) Malfunctions resulting from customer negligence or errors in handling.
(4) Malfunctions resulting from natural disasters (including, but not limited to, earthquakes, fires, and floods).
(5) Malfunctions resulting from use that does not comply with the specifications, uses, precautions for use, usage conditions, drawings, and other matters related to this product as described in our catalog, and the instructions and other markings in the accompanying documents for this product (including accessories).
(6) Customer negligence (7) Malfunctions caused by processing, repair, modification, or disassembly by the customer
(8) Malfunctions caused by other equipment
(9) Malfunctions caused by unfamiliar or unexpected uses or methods of use
(10) Malfunctions caused by the customer using the product in violation of these Terms of Use
(11) Malfunctions discovered or occurring after the customer resells the product to a third party
(12) Other cases where the Company specifies in its catalog that repair or replacement is not permitted

Repairs or replacements not covered by this warranty will be subject to a fee, and you will be required to pay the amount separately determined by the Company.

Furthermore, if the specifications are changed within 3 days of receiving the product, regardless of the changes made, the product will no longer be covered by the initial defect warranty from that point onward.

Depending on the nature of the product, manufacturing date, and specifications, repair or replacement may not be possible.

Article 15 (Modification of Price, Specifications, etc.)

The Company may modify and change the price, specifications, shipping date, order unit quantity, etc. of this product, and discontinue handling this product (hereinafter referred to as "Modifications, etc.") without prior notice.

Such revisions will be notified by changes to the product listing on this website (including removal due to discontinuation of sales) or by other methods at our discretion.

If you order this product after such revisions, you will be deemed to have approved the revisions. However, minor revisions or changes (including changes to appearance and packaging) that do not affect the specifications or details listed in our catalog will not be notified to customers.

Article 16 (Payment and Taxation)

Payment for purchased products will be made using the methods described in our catalog. We may, at our discretion, request changes to the payment method and terms you specify.

Taxation methods vary depending on the country where you receive the product.

Taxation will be governed by the tax laws of each country.

■Products Purchased from Parallel Imports, etc.

We will not handle inquiries regarding defects, scratches, or fitting issues for products purchased from sources other than authorized retailers. These products are not covered by returns or initial defect policies. Please contact your point of purchase.

■Use of Trademarks and Photographs, etc.

The management of trademarks owned by K-SPEED is handled by Bamboo Hornet, the official K-SPEED distributor in Japan.

Unauthorized use of trademarks, logos, photographs, and other copyrighted works is prohibited. Please note that prior permission and a contract are required for use.

For commercial use (excluding personal use), a fee of 30,000 yen per item per month will be charged retroactively from the time of use.

If any problems arise due to a violation of this article, the customer shall resolve the problem at their own responsibility and shall not cause any inconvenience or damage to the Company.

Article 19 (Handling of Personal Information)

The contents of the "Bamboo Hornet LLC Privacy Policy" shall apply to the customer's personal information.

Article 20 (Prohibited Actions)

The customer shall not engage in any of the following actions when using this service:

Actions that interfere with the operation of this service or that may otherwise disrupt this service:
Placing orders using another person's name or a false name
Actions that cause inconvenience, disadvantage, or damage to other customers, third parties, or our company, or actions that may potentially cause such inconvenience, disadvantage, or damage
Actions that infringe on the copyrights or other intellectual property rights, privacy, or other rights of other customers, third parties, or our company, or actions that may potentially infringe on such rights
Illegally accessing this site and altering information
