Bamboo Hornet LLC Mail-Order Terms of Service

These Terms of Service set forth the conditions for using the mail-order service (hereinafter referred to as the "Service") provided by Bamboo Hornet LLC (hereinafter referred to as the "Company") for products sold by the Company (hereinafter referred to as the "Products") that are listed in various product catalogs issued by the Company and/or in product catalogs displayed on the website operated by the Company (hereinafter referred to as the "Site") (collectively referred to hereinafter as the "Company Catalogs").

Article 1 (Application of These Terms of Service)

These Terms of Service shall apply equally to all customers who have completed the Company's purchase procedures (hereinafter referred to as "Customers") regarding the use of the Service, except where such application is naturally precluded by the nature of the Products. Customers shall use the Service after fully understanding and agreeing to the contents of the Company Catalogs and these Terms of Service.

In the event that the Company establishes separate terms, regulations, guidelines, or the like (hereinafter referred to as "Individual Terms") regarding the Products or the Service, such Individual Terms shall take precedence over these Terms of Service.

In the event of any contradiction or inconsistency between the provisions of a contract or similar document separately concluded between the Customer and the Company (including cases where specific contractual conditions were agreed upon at the time of the Customer's order) and the provisions of these Terms of Service, the provisions of these Terms of Service shall prevail.

Article 2 (Content and Service Area of the Service)

Customers may purchase Products through the Service in accordance with these Terms of Service and subject to the conditions stated in the Company Catalogs (including, but not limited to, specifications, prices, delivery methods, and precautions for use). However, due to the nature of the Products, the Company's established standards, or circumstances involving the manufacturer or the Company, certain Products may be excluded from the scope of the Service without prior notice or announcement.

Customers may use the various services provided on the Site in accordance with these Terms of Service and the precautions for use posted on the Site. In principle, the delivery area for this Service is limited to Japan. However, this excludes regions designated as undeliverable in our catalogs or other materials.

Delivery outside Japan is available only for deliverable regions and is subject to a separate agreement regarding terms and conditions, including shipping fees and customs-related costs.

For orders requiring a price quote as specified in our catalogs, or orders otherwise requiring a quote at our discretion, the price and shipping terms for the Products shall be determined based on the details of the quote.

Article 3 (Ordering Methods and Formation of Sales Contract)

Customers may place orders for the Products (hereinafter referred to as "Orders") using the methods specified in the following items. However, ordering methods may be restricted depending on the type or quantity of the Products, such as in the case of custom-made items. (1) Online Orders: Entering and submitting the required information via the shopping cart screen on this website. (2) Other methods separately approved by the Company.

An Order from a Customer shall be deemed to have been effectively received by the Company at the time the Company receives the order data specified in the preceding paragraph. If the order data cannot be received due to communication line issues or similar problems, or if the Order contains deficiencies, the Order shall be deemed invalid. In such cases, the Company assumes no liability for the Customer's inability to purchase the Products or for any damages arising therefrom.

The sales contract for the Products shall be formed at the time the Company receives the order data in accordance with Paragraph 1. However, if the Company sends a notification declining the Order to the Customer promptly after receiving it, the sales contract shall be deemed not to have been formed (retroactively). In such cases, the Company assumes no liability for the Customer's reliance on the formation of the sales contract or for any damages arising therefrom. Furthermore, if the Company deems it necessary, it may request the execution of a separate written sales contract or a modification of the sales terms and conditions. If any costs arise regarding specific customer requests concerning an order (such as special packaging or delivery instructions), the Company reserves the right to charge the customer for the actual expenses or handling fees incurred.

Article 4 (Order Changes, Cancellations, etc.)

At Bamboo Hornet LLC, we immediately begin packing and placing orders with delivery carriers after an order is finalized to ensure prompt delivery. Consequently, we cannot accept any changes to order details or cancellations during the period between the start of the shipping process and the actual delivery.

If you wish to change or cancel your order, or return the product after delivery (hereinafter referred to as "Cancellations, etc."), please proceed in accordance with the following provisions:

1. Cancellation before shipping procedures are completed (before product dispatch)

Cancellations may be accepted only within the very brief window after an order is finalized but before we begin shipping procedures. However, as shipping operations often commence immediately via automated systems, please assume that, in principle, cancellations prior to dispatch cannot be accepted.

2. Cancellation before product delivery (cancellation while in transit)

It is not possible to cancel, halt delivery, or change order details while the product is in transit to the customer. Please receive the product first, and then proceed according to the "Returns due to customer preference" section below.

3. Cancellations, etc. after product receipt (returns due to customer preference)

Cancellations, etc. after product receipt (returns due to customer preference) are accepted only within **14 days of receipt**, provided that **all** of the following conditions are met:

The product is unused and unopened.

The product shows no signs of customer-performed machining, drilling, welding, alteration, damage, or soiling.

The customer notifies the Company of their intent to return the product via the inquiry contact point within 14 days of receipt.

[Important Notes and Costs Regarding Returns]

Responsibility for round-trip shipping and incidental costs: The customer is responsible for all return shipping costs and incidental expenses incurred during the return process (prepaid by the customer). Please note that any refund issued will be the original purchase price minus the outbound shipping costs and actual expenses incurred by us at the time of shipment.

Refund Timing: We will issue the refund to your designated account within five business days after the product arrives at our facility and we have verified its condition (e.g., confirming it is unused and unopened).

Packaging and Preparation: You are responsible for preparing the shipping label and packaging the product for return or exchange.

4. Returns/Exchanges Due to Initial Defects (Damage, Deformation, etc.)

If, upon delivery, the product exhibits significant deformation that hinders operation or has initial defects in the electrical system (e.g., engine fails to start, turn signals do not flash), please contact our support desk with details **within three days of receipt** and **before installing the product on the vehicle**. If we determine the issue is attributable to us, we will provide a free repair or replacement.

[Important] Even if within three days of receipt, any product that has been installed on a vehicle—or modified or customized by the customer—is ineligible for free service regarding initial defects; all such cases will be handled on a paid basis.

5. Automatic Cancellation Due to Refusal of Delivery or Prolonged Absence (Penalty Fee)

If you refuse delivery for personal reasons, or if the product is returned to us because the delivery carrier's storage period expired due to your absence or other reasons, the sales contract will be deemed automatically cancelled.

In such cases, you will be required to pay a penalty fee covering the value of the product, round-trip shipping costs, and the full amount of any actual damages incurred by us.

6. Products Ineligible for Return or Exchange

In accordance with Articles 8 and 12, returns, exchanges, or refunds will not be accepted under any circumstances in the following cases:

More than three days have passed since receipt of the product, regardless of whether it was installed.

The product has been installed on a vehicle or modified/processed in any way.

Special-order items (custom-made products). Products purchased from third parties other than us or our authorized agents/distributors (e.g., parallel imports, private sales, used items).

Please send the products to our distribution center.

Article 5 (Shipment and Delivery Issues)

We will ship the products based on your order. However, we reserve the right to determine the specific shipping date for each order based on factors such as the type and quantity of products and the time the order was placed.

It takes time for the product to be delivered to you after the shipping date. Please check the estimated delivery times listed on this site before placing your order.

You acknowledge in advance that delivery may not be possible within the standard timeframe for your region due to factors such as adverse weather, traffic congestion, road construction, shipping periods (e.g., year-end/New Year holidays, summer holidays, mid-year/year-end gift seasons), delivery company strikes, changes in customs duties, war, conflict, earthquakes, tsunamis, or other force majeure events; we shall bear no liability for any damages incurred by you in such cases.

If the product is returned to us due to reasons attributable to you (e.g., refusal of delivery, prolonged absence, incorrect address), you shall bear all costs, including round-trip shipping fees, taxes, and other expenses required for the return, and we reserve the right to bill you for these amounts. [Handling of Issues Such as Loss or Damage During Delivery] In the event that the Product is damaged or lost during delivery, the Customer shall promptly initiate the claim process for EMS insurance (or the delivery guarantee system provided by the carrier) with the post office or the delivery carrier upon receipt of the Product. As the claim for the delivery guarantee must be filed by the recipient (the Customer), filing such a claim is a condition of the service usage agreement. Should the compensation resulting from the delivery guarantee be deemed insufficient, the Company will discuss the matter with the Customer in good faith on a case-by-case basis; however, if the Customer fails to file a claim for the delivery guarantee, the Customer shall be deemed to have waived their right to such a guarantee, and the Company shall not provide any form of compensation (such as replacement products or refunds).

Article 6 (Delivery of the Product)

Delivery of the Product shall be deemed complete upon its arrival at the delivery address specified by the Customer (subject to any regional limitations designated by the Company). Please note that for heavy or large items, the delivery method may be specified separately by the Company, such as "curbside delivery" (delivery to the vehicle). Upon receipt of the Product, the Customer shall affix their seal or signature to the delivery carrier's slip.

Delivery may not be possible if the Customer's residence or location cannot be verified—for instance, if a nameplate is not displayed at the delivery address.

If the Customer requests delivery to a location other than the one registered or specified, the delivery carrier or the Company may request the presentation of official identification (such as a driver's license, health insurance card, or passport) to verify the recipient's identity, and the Customer agrees to this procedure (in such cases, information such as the address, name, and identification number may be recorded).

Article 7 (Termination of Contract Due to Refusal of Receipt, etc.)

If the Customer refuses to accept the Product, or if delivery to the designated address cannot be completed due to circumstances attributable to the Customer (such as absence) and the delivery carrier’s storage period expires, the Company may deem the sales contract for said Product to be automatically terminated. In such a case, the Customer shall pay the Company, as a penalty, an amount equivalent to the price of the Product, round-trip shipping costs, and any damages incurred by the Company. However, this provision shall not apply if the Company acknowledges special circumstances and handles the matter differently.

Article 8 (Obligation to Inspect the Product)

Upon receipt of the Product, and prior to installation on a vehicle and within three days (including the day of receipt), the Customer must inspect the Product (hereinafter referred to as "Inspection") regarding its name, model, quantity, and the presence or absence of damage, deformation, defects, or other non-conformity with the contract (hereinafter collectively referred to as "Defects, etc.").

If specific notification regarding Defects, etc., is not made to the inquiry contact point listed on this website within the period specified in the preceding paragraph, the Product shall be deemed to have passed Inspection.

Even if within three days of receipt, if the Product is installed on a vehicle—even once—it shall be deemed to have passed Inspection at that point, and no subsequent claims regarding initial defects will be accepted.

Article 9 (Measures in Case of Failure to Pass Inspection)

If Defects, etc., are discovered in all or part of the Product during the Inspection described in the preceding Article and notification is made within the period specified therein, the Company shall—only after confirming the relevant Product and clearly determining that the issue is attributable to the Company—promptly deliver a replacement product or, based on consultation with the Customer, refund the price corresponding to the defective portion. The Customer shall bear the burden of preparing shipping documents and performing packaging work associated with any return or exchange. Article 10 (Exemption from Liability for Force Majeure)

In the event that the delivery of the Product is delayed or rendered impossible due to natural disasters (including but not limited to earthquakes, floods, and fires), the enactment or amendment of laws and regulations, actions taken by public authorities, accidents or issues involving transportation facilities, labor disputes, or other unavoidable circumstances beyond the Company's control, the Company shall notify the Customer to that effect within a reasonable period. The Company shall not be liable for any damages or expenses incurred by the Customer or any third party as a result of such events.

Article 11 (Handling of Excess Deliveries)

If, due to an error on the part of the Company, a quantity of the Product exceeding the ordered amount is delivered, the Customer shall contact the designated inquiry desk and promptly return the excess items to the address specified by the Company. The Company shall bear the return shipping costs in such cases.

Article 12 (Prohibition of Returns and Exchanges After the Expiration of the Period)

Once the inspection period stipulated in Article 8 (within three days of receipt and prior to installation) has expired, the Company will not accept any returns, exchanges, or refunds for the Product, regardless of the reason.

Article 13 (Obligations Regarding Usage and Acknowledgment of Characteristics)

By placing an order for the Product, the Customer is deemed to have fully understood and agreed to the characteristics and prerequisites of custom bikes and custom parts set forth in the following items. The Company assumes no liability for any damages arising from the use of the Product by the Customer or a third party in a manner contrary to these prerequisites.

Prerequisites regarding custom bikes: (1) Custom bikes may not be covered by the manufacturer's warranty provided by the manufacturer of the base vehicle. (2) The Company does not guarantee compliance with all laws, regulations, and safety standards (including vehicle safety standards) of countries worldwide. (3) The Product possesses aspects of an art piece (intended for viewing) that prioritizes design. (4) Regarding operation on public roads, the Product does not necessarily comply with the laws and regulations of every country, and the Company cannot provide any guarantee regarding use on public roads. Use on public roads is entirely at the purchaser's (customer's) own risk. (5) We do not perform specific modifications to ensure compliance with the laws and regulations of individual countries. If modifications or adjustments are required after purchase to meet local regulations (including Japanese safety standards), the purchaser must carry them out at their own expense and responsibility.

Characteristics of custom motorcycles and custom parts (1) Custom motorcycles are designed for aesthetic enjoyment. As they are created by disassembling standard vehicles and installing different components, additional processing—such as grinding, drilling, or welding—is involved. Such processing may result in minor scratches or scuffs. (2) Custom parts are not OEM (original equipment manufacturer) parts. Consequently, products may exhibit slight warping or color variations, or gaps may occur at the mounting points on the vehicle body. (3) All products we handle are custom vehicles or custom parts and differ fundamentally from mass-produced items made by major automotive or motorcycle manufacturers. Installation may require modifications or fine-tuning, such as grinding parts to fit the vehicle, adjusting shapes, or altering bracket angles. Customers agree to proceed with the transaction understanding the nature of custom parts, specifically that "plug-and-play" installation (installation without modification) may not always be possible. (4) We do not maintain the same maintenance or after-sales support systems as mass-market vehicle manufacturers (including, but not limited to, providing loaner vehicles or services for registering "Class 2" mopeds/scooters), and we cannot offer such services. (5) As these are not mass-produced items, they incorporate a combination of commercially available parts; specifications for individual components may change without prior notice. (6) To ensure compliance with Japanese safety standards, some parts may differ from those shown in catalogs or photographs upon delivery. (7) The installation and use of custom parts are entirely at the purchaser's own risk. Any scratches, deformation, or damage occurring during installation or use are excluded from warranty coverage under all circumstances. (8) Adding custom parts may alter the vehicle's balance or aerodynamic drag, potentially affecting driving performance (including fuel economy, acceleration, handling, etc., as well as changes resulting from the installation of large-diameter tires); however, the Company makes no guarantees regarding any such effects. (9) Custom vehicles and custom parts are not suitable for customers who expect the same level of performance, paint finish, and balanced uniformity found in mass-produced vehicles from major manufacturers. In such cases, please choose a standard vehicle (factory-original model).

Article 14 (Product Warranty and Initial Defects)

If a significant initial defect attributable to the Company (such as electrical system malfunctions—e.g., the engine failing to start, turn signals failing to flash, or the horn failing to sound) is identified in the Product within three days of receipt, the Company will provide free repair or replacement of the Product (hereinafter referred to as "this Warranty"), provided that the customer notifies the Company in writing (including via electronic records) detailing the defect. In such cases, the Company may commission the repair from the Product's manufacturer. Note that custom-ordered products are excluded from this Warranty.

If the Product is covered by a separate product warranty issued by the manufacturer, the Company shall apply the terms of that manufacturer's warranty.

Even within the warranty period, the Product will be excluded from this Warranty (and any repairs will be subject to a charge) if any of the following circumstances apply: (1) Malfunctions resulting from use for purposes other than the intended use (2) Malfunctions resulting from the use of the Product in aerospace equipment, nuclear equipment, weaponry, armaments, or other military applications (3) Malfunctions resulting from the customer's careless handling, negligence, or operational errors (4) Malfunctions resulting from natural disasters (including, but not limited to, earthquakes, fires, and floods) (5) Malfunctions resulting from use that does not comply with the standards, intended uses, precautions, operating conditions, and drawings listed in our catalogs, or with the information provided in the documents accompanying the Product (including accessories) (6) Malfunctions resulting from processing, repair, modification, or disassembly (including specification changes) performed by the customer or a third party (7) Malfunctions caused by other equipment or components (8) Malfunctions resulting from experimental use, or from use for purposes or methods that are untested or unforeseen (9) Malfunctions resulting from the customer's use of the Product in violation of these Terms of Use (10) Malfunctions discovered or occurring after the customer has resold the Product to a third party (11) Other matters explicitly stated in our catalogs or similar materials as being excluded from the scope of our warranty

Any repair or replacement not covered by this warranty shall be performed on a paid basis, and the customer shall pay the costs separately stipulated by us (including technical fees, parts costs, round-trip shipping fees, etc.).

Regardless of the specific areas modified or altered, if the customer performs specification changes, customization, or similar actions within three days of receiving the Product, the Product shall no longer be eligible for claims regarding initial defects from that point onward.

Depending on the nature of the Product, its date of manufacture, its specifications, or the availability of parts, repair or replacement may not be possible, even on a paid basis.

This product is designed to support the lower back of a person of average build and weight while driving. It may break if subjected to excessive loads or strong impacts. * Please note that we cannot provide a lifetime warranty against functional degradation caused by normal wear and tear over time.

The screws and bolts used are of high strength.
Applying excessive force during installation may cause damage.
Breakage of screws or scratches incurred during installation are not covered by the warranty, regardless of the reason.
Please acknowledge this before purchasing.

Article 15 (Revisions/Changes to Prices, Specifications, etc., and Discontinuation of Handling)

We reserve the right to revise or change the price, specifications, details, scheduled shipping date, order unit quantity, etc., of the Product, or to discontinue handling the Product (hereinafter referred to as "Revisions, etc."), without prior notice to the customer. Any such modifications shall be announced via changes to the content posted on this site (including removal due to the discontinuation of a product) or by other methods deemed appropriate by the Company.

If a customer places an order for the Product after such modifications have been announced, the customer shall be deemed to have accepted said modifications. Please note that minor changes—such as adjustments to packaging or environmental considerations—that do not affect the Product's essential standards or specifications may not be announced to customers.

Article 16 (Payment and Taxation)

Payment for the Product shall be made using the methods specified in the Company's catalog. However, the Company may request changes to the designated payment method or terms due to operational reasons or credit-related issues.

Prices displayed on this site are, in principle, listed as "shipping included, tax excluded" (tax added at checkout).

For deliveries outside Japan, taxation methods vary depending on the country or region where the customer receives the Product. Taxation shall be subject to the tax laws and local customs regulations of the destination country.

The purchaser (customer) is responsible for directly paying and handling any Value Added Tax (VAT), consumption tax, customs duties, customs clearance fees, or similar charges incurred in the destination country, in accordance with local regulations and at their own expense; the Company assumes no liability whatsoever regarding these matters.

Article 17 (Inquiry Channels and Exclusion of Parallel Imports)

Customer inquiries regarding this product and this service will be accepted via the designated inquiry channels (such as forms) on our website.

[Exclusion of Parallel Imports, etc.] We will not provide any support—including handling of defective products, compensation for damage, technical support regarding installation, returns, or handling of initial defects—for products purchased from third parties other than us or our authorized distributors (authorized sales channels). This applies to parallel imports, items purchased through private transactions, used goods, and the like. Please direct any inquiries regarding such items to the seller from whom they were purchased.

Article 18 (Copyright and Damages for Unauthorized Use of Trademarks, Photos, etc.)

Customers may not use (including reproduction, reposting, alteration, public transmission, etc.) any information, images, designs, or other materials provided through this service beyond the scope of private use permitted under copyright law without the prior permission of the copyright holder.

[Restrictions on Use of Trademarks, Photos, etc., and Penalties] The right to manage the trademarks, logos, photos, images, text, and other copyrighted works (hereinafter referred to as "Our Intellectual Property") owned by the "K-SPEED" brand within Japan belongs to Bamboo Hornet LLC, the official K-SPEED distributor in Japan. Unauthorized use of Our Intellectual Property (including, but not limited to, commercial use or unauthorized reposting on social media) is strictly prohibited. Parties wishing to use such materials for commercial purposes must obtain our written permission and enter into a license agreement in advance.

If it is discovered that a customer (or the relevant user) has violated the provisions of the preceding paragraph by using Our Intellectual Property for commercial purposes without prior permission, said customer (or user) shall, upon our request, immediately pay damages (a penalty) calculated retroactively to the start of such use at a rate of 30,000 yen (excluding consumption tax) per month for each copyrighted work or trademark used. In the event that a dispute arises with a third party due to a violation of the provisions of this Article, the Customer shall resolve such dispute at their own expense and responsibility and shall not cause any trouble or damage to the Company.

Article 19 (Handling of Personal Information)

The handling of the Customer's personal information shall be governed by the provisions of the "Bamboo Hornet LLC Privacy Policy" separately established by the Company, and the Customer agrees to the same.

Article 20 (Prohibited Acts)

When using the Service, the Customer shall not engage in any act that falls under any of the following items, or any act that carries a risk of doing so: (1) Acts that interfere with the operation of the Service or otherwise hinder the Service. (2) Acts of placing orders using another person's name or false information (name, address, credit card information, etc.). (3) Acts that cause trouble, disadvantage, or damage to other customers, third parties, or the Company. (4) Acts that infringe upon the copyrights, trademark rights, or other intellectual property rights, privacy, or other rights of other customers, third parties, or the Company. (5) Acts of unauthorized access to the Site, falsification of information, or the transmission or posting of harmful computer viruses or programs. (6) Acts that violate public order and morals or otherwise violate laws and regulations. (7) Acts of assigning, reselling, or pledging as collateral to a third party any status, rights, or obligations under a sales contract arising from the use of the Service. (8) Any other acts that the Company reasonably deems inappropriate.

Article 21 (Disclaimer and Limitation of Liability)

The Company assumes responsibility only for the specifications of the Product expressly stated in the Company's catalog; the Company makes no warranties—whether express or implied—regarding the Product's suitability for a particular purpose, utility, compatibility or interoperability with other companies' products, sales period, or any other matter. Except in cases where the Company has acted with willful misconduct or gross negligence, or where the Company bears liability under the Product Liability Act, the Company shall not be liable to the Customer for any damages arising in connection with the Products or the Services (including direct, indirect, special, or consequential damages, lost profits, etc.).

The Customer may not claim damages from the Company if the Customer violates the usage precautions or prerequisites stated in the Company's catalog or these Terms of Use.

In the event that the Company bears legal liability to the Customer regarding the Services, the amount of damages payable shall be limited—regardless of the reason—to the total purchase price paid by the Customer to the Company for the specific Product that was the direct cause of the damage.

Article 22 (Interruption or Suspension of Services)

The Company may temporarily interrupt or suspend the provision of all or part of the Services without prior contact, notice, or warning to the Customer in any of the following cases: (1) When a failure or malfunction occurs in the order processing system or equipment due to natural disasters (earthquakes, floods, fires, etc.), power outages, or line failures of telecommunications carriers. (2) When the manufacture or delivery of the Products becomes difficult due to natural disasters, the enactment or amendment of laws and regulations, labor disputes, or other unavoidable circumstances. (3) When performing scheduled or emergency maintenance on the order processing system, this Site, or related equipment. (4) When the Company otherwise determines that interruption or suspension is necessary for the operation of the Services.

Article 23 (Special Provisions Regarding Internet Services)

When the Customer uses this Site to view information or receive various services (hereinafter referred to as the "Internet Services"), the Customer shall do so at their own risk and in compliance with these Terms of Use, as well as any individual rules, precautions, and applicable laws and regulations. While we strive to improve the quality of the information and services provided through this Internet service, we make no warranties—express or implied—regarding their safety, reliability, usefulness, suitability for a particular purpose, currency, legality, or morality, nor do we guarantee that they are free from computer viruses.

Although we implement security measures to prevent information leakage, the customer acknowledges that, due to the nature of Internet communications, it is impossible to completely eliminate the risk of information leakage or similar incidents.

We shall not be liable for any damages arising from the use of this Internet service (including damages resulting from the non-delivery or delay of order data placed via this site), except in cases where such damages are caused by our willful misconduct or gross negligence.

We shall not be liable for any malfunctions or damages resulting from the use of this Internet service in an inappropriate manner other than its intended use.

Article 24 (Revision or Modification of These Terms of Use)

We reserve the right to revise, modify, or amend these Terms of Use (hereinafter referred to as "Revisions") in accordance with Article 548-4 of the Civil Code (Modification of Standard Terms and Conditions).

In the event of such Revisions, we shall notify customers of the revised content and the effective date prior to said date by posting the information on our website or by other means we deem appropriate.

The revised Terms of Use shall apply from the effective date specified in the preceding paragraph.

Article 25 (Handling of Partial Invalidity of Provisions)

Even if any provision of these Terms of Use, or a part thereof, is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms of Use—as well as the remaining parts of the provision determined to be partially invalid—shall continue to remain in full force and effect. Article 26 (Resolution through Consultation)

Any matters not stipulated in these Terms of Use, or any questions arising regarding the interpretation of these Terms of Use, shall be resolved amicably through good-faith consultation between the Customer and the Company.

Article 27 (Governing Law and Agreed Jurisdiction)

These Terms of Use shall be governed by and construed in accordance with the laws of Japan.

The Yokohama District Court shall have exclusive jurisdiction in the first instance over any and all disputes (including judicial disputes) relating to the Product and the Service.
